SESSION 4

Basics of Criminal Case Consulting Part I | Teresa Devitt-Lynch

Legal Nurse Consultants can contribute significantly to the prosecution or defense of persons indicted for causing death or bodily injury via gunshot wounds. The LNC's role is not to determine whodunnit in these types of cases, but rather to evaluate and analyze the medical evidence available to assist attorneys in mounting strong prosecution or defense litigations. Through this presentation, you will be able to evaluate medically-relevant indicted charges and analyze the available medical evidence to support or refute those charges.

You will be able to evaluate the criminal charges associated with gunshot wounds, discuss the process of forensically analyzing the medical evidence and look for a connection between the medical evidence and the indicated charges.

How to Win More Clients Darin Adams

You know your LNC business like no one else. The problem is that it’s not enough to just be good at what you do. When a business fails, it’s often because it wasn’t organized to run or grow efficiently. Thanks to new technology, you can concentrate on your strengths and let new tools help you get organized and take care of the steps that will make you successful.

  • · How can you do better at “speed to lead”? Getting the new contact in your business system in record time allows you to follow up with them better.
  • · Make it easy for your customer to contact you and schedule time with you. If it’s as easy as clicking on a button, it will happen more often.
  • · Stay in touch and you’ll be “top of mind”. If you are providing a real solution, your audience wants to hear from you more often.

The best part is that, while marketing and sales can be overwhelming, tools are available that make it easier than ever before.  It now can happen in seconds, not days. Darin shares tips to accomplish these goals in this fast-paced session.

How to Prove Damages Sam Davis

How do you prove the extent of a plaintiff’s injuries? Each side of the case has a different agenda. The plaintiff attorney wants to invest resources in demonstrating the permanence and impact of the trauma. These cases will be the big winners. The defense wants to disprove causation and the extent of the harm to minimize payments.

What makes a case valuable for either side and how does the legal nurse consultant help the attorney prove or dispute damages?

Was There Pain and Suffering? Peter Salgo

What exactly is pain and suffering? Can a plaintiff testify about pain and suffering? Most attorneys and experts know the quality of explanations is high when a physician or nursing expert gets involved. What does a physician look for in the medical records to establish if there was pain and suffering? How is that the same or different from how an LNC evaluates the medical records? In this fast-paced interview, Dr. Salgo will pull back the curtain on this hot topic.

Visualizing the Case: Simplifying Medical Complexities

The presentation will detail the three reasons medical visuals are most commonly used to win personal injury and medical malpractice cases. Specific case studies will be examined to show how liability is established, damages are built, and medical complexities are simplified. Attendees can expect to learn how expertise and reports from legal nurse consultants are frequently used in the preparation of visuals and how they can educate attorneys about the importance of visuals to maximize case values.

Electronic Records: Mining for Data

This program gives you the tricks of the trade for electronic records, common IT terminology, and key factors to review.

Reviewing a printed version of an electronic chart may or may not show exactly what the provider or clinician documented in the chart. Did the charting go directly into the software or was it a report scanned in from another system?  Paying close attention to small printed items or “stamped” items on the printed pages can give guidance on an interfacing system to request data from.  Identifying the correct terminology of what you are requesting to review can be crucial in your success of getting what you need.

The Role of the LNC in Defense Cases

What happens in litigated claims when the LNC works with the claims adjuster and defense counsel? Because litigated claims often involve complex medical issues and complicated injury information, the LNC's role is to provide the defense team with a deeper analysis and understanding of the injury data points and how they work strategically in the case.

While the LNC's work product will vary, e.g., a chronology or timeline, or information to assist with a line of questioning, all roads lead to the Mechanism of Injury (MOI). Analysis of the medical data points and how they do, or do not align with the MOI is a crucial part of the defense work up.  This presentation will take a deep dive into MOI and how a sound analysis will help build a strong defense case.
