What Were They Thinking? Tales of an Expert Witness

An expert witness may get involved when the Board of Nursing looks at a registered nurse’s actions.

Laura Conklin’s varied clinical experiences led her to believe she’d seen it all in acute care, but were her eyes opened when she began reviewing cases for the Board of Nursing!

Laura analyzed several hundred cases to determine the most common allegations against nurses. She culled through her notes to find the most shocking stories, which she will share with you during this session.

Laura A Conklin is president of Conklin and Associates, LLC, where she assists plaintiff and defense attorneys as an expert witness. Laura retired as a Professor of Nursing in 2019 from Wayne County Community College District.

She served as an expert witness for the Bureau of Health Professions of the Michigan Department of Licensing and Regulatory Affairs, and was a consulting expert for the Michigan Department of the Attorney General.

Laura is the author of Shocking Stories of Nursing: Memories of a 50-Year Nursing Career, available on Amazon.com, and the forthcoming book, More Shocking Tales of Nursing: What Were They Thinking?

When Pulses Go Missing: Case Analysis

Alissa is a vibrant 19-year-old who enters the OR for an anterior/posterior synovectomy. Surgery is uneventful, and she receives bupivacaine post operatively. On the nursing unit afterwards, she complains of increased pain and lack of sensation and movement of her left foot.

Mock Trial

The session starts with tips on how to testify. Next, you will see a recreation of the testimony of the 2 nurse defendants in Alissa’s case.

You’ll be the jury as you decide on the liability, if any, of the defendants.

Pat reviewed her first case as an expert witness in 1987. She spent the next 25 years reviewing medical surgical cases, writing reports, being deposed, and testifying in depositions and trials. 

Pat is a past president of AALNC and the host of Legal Nurse Podcast and Writing to Get Business Podcast.

As an independent legal nurse consultant, Pat founded a highly successful independent legal nurse consulting business.

Nursine Jackson is a Master’s-prepared Cardiovascular Clinical Specialist and a Legal Nurse Consultant. She has been instrumental in assisting plaintiffs’ attorneys in developing mechanisms to incorporate electronic medical records into their practices.

She chaired the international committee that updated the audit trail standard ASTM e2147 in 2018 and then led the crusade to have this updated standard incorporated into law via the Cures Act. The Final Rule of the Cures Act was published on May 1, 2020, making ASTM e2147-18 the law.

Ms. Jackson screens and evaluates cases for merit and then provides support throughout the development of medical-legal-cases. She enjoys the challenge of navigating electronic health records for firms and advising on strategies to obtain and use eDiscovery.
