It was a dark and stormy night when the EMS got the call: “Come to the scene of a T bone crash and rollover.” One car struck another at 70 MPH.

Our crash victim had multiple rib fractures and a pelvic fracture. He sustained serious injuries and was in the ICU, on a ventilator, and trached. Our 4 clinical speakers will reveal his story, piece by piece.

Arlene Klepatsky Esq RN is an attorney at law in California and is experienced in evaluating  motor vehicle crashes after 20+ years of working with a biomechanics / causation of injury expert. She co-developed an ABA-approved, university-based LNC program and taught in it for nearly 10 years. She contributed 2 chapters to Legal Nurse Consulting, Principles and Practices, Second Edition, edited by Pat Iyer. Arlene also wrote multiple journal articles.

Our respiratory therapist Joe Curro will address standard of care for a trach patient as well as travel with a trach patient.  He will also discuss different types of equipment, sleep apnea and other respiratory care issues. This session reveals a medical malpractice twist in the case. 

A lifetime respiratory therapist, Joe Curro held positions as a clinician, educator, and administrator. He is the past Director of Pulmonary Services at Brigham & Women's Hospital and the Dana Farber Cancer Institute in Boston.  In addition, Joe managed the Pulmonary Diagnostic and Pulmonary Rehab Departments at Brigham & Women’s Hospital. Joe’s responsibilities included respiratory care of the adult, newborn and ECMO population. In addition, Joe is currently adjunct faculty at Northeastern University and Harvard Medical School. Joe has been involved with medical-legal review since 2006 and has collaborated with numerous LNC's on a variety of pulmonary, mechanical ventilation, and emergency airway issues.

Barbara Levin BSN RN ONC CMSRN LNCC is a medical surgical expert witness who has testified in cases involving orthopaedic trauma. She is the Clinical Scholar of the orthopaedic trauma unit at Massachusetts General Hospital.  Barbara served as the Chair of the Massachusetts Board of Registered Nurses and was the President of the AALNC.  Barbara has been published on many orthopaedic and legal nursing topics and has collaborated with Pat Iyer on several publications.

Joe Flores MSN RN NP, ESQ is both a nurse practitioner and an attorney in Texas. He has practiced in several areas of the law, including criminal, personal injury, traumatic brain injury cases, whistleblower law, and the defense in cases where nursing and the law overlap.

While Joe earned his BSN, he started reviewing medical records for attorneys. His expert witness work helped fund his nurse practitioner program and law school. Joe feared attorneys when he was a nurse and did not think of becoming one.

His first case as a legal nurse consultant changed his perspective when he found the nursing home lied about how much a resident ate and starved them on purpose. Joe serves in a dual role now: trial attorney and nurse practitioner.
